- Consent (Art. 6 para. 1  lit. a GDPR): The affected person has given consent for a specific purpose.

- Contractual performance and pre-contractual inquiries (Art. 6 para. 1 lit. b GDPR): Processing is necessary for the performance of a contract or in order to take steps at the request of the data subject prior to entering into a contract

- Legal obligation (Art. 6 para. 1 lit. c GDPR): for example invoices are retained for accounting purposes.

- Legitimate interests (Art. 6 para. 1 sentence 1 lit. f GDPR): Processing is necessary for the purposes of the legitimate interests pursued by the controller or by a third party

1. Use of the services on the website www.homefinding.at and other online services

2. Responding to inquiries from prospective buyers/tenant or property owners in connection with real estate brokerage (brokering real estate for purchase/rental) and related activities (including automatically generated and archived text documents, such as correspondence) in these matters.

With regard to your data stored, you have the following rights:

• Information within 4 weeks of submitting your request (proof of identity required!)

• Rectification (e.g., completion)

• Erasure (right to be forgotten)

• Restriction of processing (e.g., regarding data scope, duration, etc.)

• Objection to processing based on Article 6 Abs 1 lit f GDPR

• Lodge a complaint with the supervisory authority.

However, there is no right to data portability.

You can contact us by phone, eMail, real estate portals, eMail, social media, or through existing business relationships. You are contacting us as a prospective tenant/buyer or property owner.

When you contact us, the data you provide will be stored and processed by us for the purpose of handling your inquiry, for any follow-up questions, and for addressing your request. We process the personal data you provide (name, eMail address, phone number, etc.) and the content of your inquiry.

If you contact us via social media, we receive your data from the respective platform operators.

We process this data, which is necessary for our business purposes as real estate agents (offering and brokering properties, managing prospective buyers and clients in the context of real estate brokerage (including automatically generated and archived text documents such as correspondence, etc., related to these matters)) and to answer your questions in response to your inquiry.

  • Title
  • First name
  • Last name
  • Telephone number
  • Email address
  • Reason for contact

 

If you are offering us a property, the following data will be collected in addition to the above:

  • Full address of the property
  • Price
  • Living area
  • Features
  • Your address

 

C2. Legal Basis + Purpose:

 

Prospective tenant (first-contact commission rule): 

The processing of personal data is carried out:

a) within the scope of the brokerage agreement with the landlord for the purpose of initiating a contract (brokering a lease agreement), thus Art. 6 para. 1 lit. b GDPR, and

b) on the legal basis of the legitimate interest (Art. 6 para. 1 lit. f GDPR) of the controller or a third party (landlord): Our legitimate interest also lies in answering your inquiry individually and technically efficiently for the purpose of contacting you as requested. The collection of contact details is necessary for processing the inquiry (sending a property exposé with address details, clarification/arrangement of a viewing appointment), for any follow-up questions (application as a tenant, processing of proof of income to ensure that the landlord does not suffer any payment default, etc.), as well as for communication/correspondence within the scope of real estate brokerage and related activities (including automatically generated and archived text documents).


 

Property owners (brokerage agreement) or prospective tenants/buyers of commission-based properties (brokerage agreement, search mandate): In addition to Article 6 para 1 lit b GDPR, we rely on the protection of our legitimate interests Aticle 6 para 1 lit GDPR. A pre-contractual measure (sending property offers by eMail; contacting you for the purpose of property acquisition) is required.

We process your data in connection with your inquiry for the purpose of providing you with an individual response (e.g., scheduling a viewing appointment, providing property details, acquiring property information, processing property data for the purpose of brokering the property, etc.).

 

The following actions are taken when you contact us - Prospective tenant/ buyer

  • Registration in our database as a client
  • Sending you information about the properties you requested, including the exact address
  • Scheduling viewing appointments
  • Further suitable offers, provided we have similar properties available
  • Sending you the application forms for a specific property, sending you the lease agreement and related documents
  • All similar real estate services related to property brokerage

 

The following actions are taken when you contact us - Property Owner

  • Registration as a property owner
  • Registration of your property in our database
  • Offering the property to clients
  • Sending you application documents from prospective tenants/buyers, sending you the lease agreement and related documents
  • All similar real estate services related to property brokerage

 

C3. Data Retention Period

We store your data only as long as necessary to process your application, unless statutory retention periods or limitation periods apply, or potential legal claims have not yet expired.

 

Prospective Tenant/ Buyer

Data is retained for the duration of the brokerage activity and, after its termination, at least as long as statutory retention periods (e.g., seven years after the end of the fiscal year pursuant to Section 132 of the Austrian Federal Fiscal Code) apply or the limitation periods for potential claims have not yet expired.

Inquiries with/without viewing: maximum 12 months, deletion no later than the end of the current fiscal year.

Inquiries received after December 15th of the fiscal year will be deleted in the following fiscal year.

Applications as a tenant/offer to buy: until it is clear that no claims exist or statutory retention is no longer necessary.

Applications as a tenant accepted/purchase offer accepted: 7 years after the end of the fiscal year.

 

Property Owners

The data will be stored for the duration of the brokerage agreement and, after its termination, at least as long as statutory retention periods apply or the limitation periods for potential legal claims have not yet expired. This is generally 7 years after the end of the fiscal year.

 

C4. Recipients of the Data

We will not disclose your data without your consent, except to the following group of people if necessary:

 

Prospective Client

Data will only be disclosed to the extent necessary within the brokerage firm, to the client or their representative, and insofar as it is necessary for initiating a contract (brokering a lease/purchase agreement) or if there is a legitimate interest of involved third parties in the business transaction.

Potential recipients include:

  • Departments within the company involved in business transactions (e.g., IT, other administrative units)
  • Third parties involved in business transactions (individuals necessarily participating in the transaction and potential contractual partners, property management companies)
  • If necessary, service providers of the data controller (e.g., tax advisors, payroll services, lawyers) as well as public authorities (social security, tax office, other authorities), legal representatives (for the enforcement of rights or defense against claims or in the context of official proceedings), or companies that act as contractors in the maintenance of the IT infrastructure (software, hardware).

Under no circumstances will your data be shared for advertising purposes or similar uses. Our employees and service providers are bound by confidentiality agreements and are obligated to comply with data protection regulations.

 

Property Owners

We store and process the personal data transmitted or disclosed to us only to the extent necessary for the execution of the contract (brokerage agreement). Data is only shared to the minimum extent required for contract execution, based on a legal basis, or where a legitimate interest of involved (third) parties exists.

Possible recipients include:

  • Third parties involved in the business transaction, such as the relevant departments of the property management company or companies within the corporate group; private and public authorities that may disclose or require information related to the property (e.g., chimney sweeps); financing companies; insurance companies; tax offices and other authorities; tax advisors and legal representatives (for the enforcement of rights or defense against claims, or in the context of official proceedings);
  • Companies commissioned to maintain our internal IT infrastructure (software, hardware);
  • Contracted professionals/service providers (e.g., for contacting you regarding damage repair)
  • Owner/property management company in the context of termination/transfer of management responsibilities
  • Other co-owners of the property (accounting, decision-making)

 

D. DATA SECURITY

Standard measures have been implemented to protect your data from unauthorized access, disclosure, reproduction, use, and modification. These measures include firewalls, encryption, and access control.

Our staff is also trained in confidentiality and the careful handling of data.

However, it cannot be completely ruled out that, due to errors in data transmission not caused by us or unauthorized access by third parties (hackers), information may be viewed and used by unauthorized persons.

We cannot accept liability for such incidents, unless such access was caused by our negligence.
